  • Clients acknowledge that engaging our services does not ensure business success, and ODE Digital cannot be held liable if campaigns or strategies do not meet expectations.

Client Responsibilities

  • Clients are responsible for providing accurate and timely information, brand assets, approvals, and access to necessary platforms (e.g., social media, Google Ads, website admin).

  • Delays caused by the client in providing required information or approvals may affect deadlines, and ODE Digital will not be responsible for such delays.

Limitation of Liability

  • To the fullest extent permitted by law, ODE Digital shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our services or website.

  • This includes, but is not limited to, lost profits, business interruptions, data loss, or reputational damage.

  • Our liability, if any, shall be strictly limited to the amount paid by the client for the specific service in question.

Third-Party Services

  • Our work may involve the use of third-party tools and platforms (such as Meta Ads, Google Ads, Wix, Klaviyo, or Canva).

  • ODE Digital is not responsible for the performance, availability, or policies of these third parties.

Termination

  • Either party may terminate the service agreement with written notice, subject to the cancellation terms specified in the proposal or subscription.

  • ODE Digital reserves the right to terminate services immediately in the event of non-payment, breach of these Terms, or misuse of our services.

Governing Law

These Terms and Conditions are governed by the laws of Western Australia, and any disputes shall be subject to the jurisdiction of the courts of Western Australia.
